Bresnan Service Assurance Plan Terms and Conditions
We are pleased that you have selected Bresnan's Service Assurance Plan, the inside wire repair plan provided by Bresnan Communications, LLC ("Bresnan"). By subscribing to the Bresnan Service Assurance Plan, you agree to be bound by these Terms and Conditions.
In general, under the Service Assurance Plan, Bresnan will identify wiring trouble locations within your home and repair or replace inside telephone wire, telephone jacks, inside cable wire and/or Internet wiring, cable outlets, and replace the battery in equipment associated with Bresnan Digital Phone service.
Specific items covered under the plan include:
- Trouble Location associated with Customer Equipment which occurs when Bresnan determines that a service problem is caused by issues with customer owned video, audio, voice and data equipment such as TVs, DVD players, VCRs, audio receivers, speakers, computers, customer owned modems and telephone sets.
- Inside Telephone Wire - This is the telephone wiring inside of a house that connects customer-owned telephone equipment to Bresnan's network at the network interface. (usually a small box on the outside of your home).
- Telephone Wall Jacks - A telephone jack is commonly fixed to a wall or baseboard and connects to the telephone wiring in a home.
- Inside Cable TV and Data Wiring - This is the cable inside of your home that connects your customer-owned video and data equipment such as a TV and computer or laptop to Bresnan's network at the network interface.
- Data Cable or Ethernet Cable - The cables used to connect data equipment such as a computer or laptop to a cable modem or router.
- Coaxial Cable Connectors - This is the cable that connects customer-owned video (TV) and data (computer) equipment to each other and to a cable TV outlet.
- Cable TV Outlets - A cable TV outlet is commonly fixed to a wall and connects the cable wiring in a home to a cable TV box or video equipment such as a DVR or VCR.
- Coaxial Cable Splitter - This equipment splits the signal from one central location to provide cable TV or data service to multiple rooms in the home.
- Telephone Battery - In the event that your Bresnan Digital phone backup battery fails, we will offer one replacement battery at no additional cost.
- HDMI Cable - High Definition Multimedia Interface (HDMI) cable is an all-digital cable connector that can carry high definition video and several audio channels all on one cable.
- Video Cable - Cables used to connect audio and video equipment such as TV, surround sound speakers and DVD players.
- Customer Education for Bresnan owned and industry standard customer owned video equipment including TVs, DVD players, VCRs, and Bresnan provided cable boxes and remotes.
Under the Bresnan Service Assurance Plan, when Bresnan is notified by you of service problems, Bresnan will identify whether the problem is with your inside telephone wire, inside cable wire, telephone jacks or cable outlets or whether other on site equipment may be the problem. If the trouble is covered by the Bresnan Service Assurance Plan, Bresnan will repair or correct the trouble in a reasonable manner.
You acknowledge that Bresnan may reroute wire along baseboards and other locations to avoid replacement or repair in drywall, plaster or other materials. Bresnan will NOT do wall fishing under the terms of the Service Assurance Plan and will not remove pieces of wall, plaster, or sheetrock to access wiring. You shall be responsible for the cost of removing, repairing and replacing any wall, plaster or sheetrock that is required to access wiring.
Excluded from Bresnan Service Assurance Plan coverage are the following:
- Telephone wire, internet wire and cable wire located beyond the demarcation point outside of your home.
- Rewiring after a home is destroyed or damaged by fire, flood, earthquake, Acts of God, vandalism, gross negligence or willful damage.
- Initial installation of service and the installation of new jacks, new wiring or rewiring. These services will be performed at our regular installation and service rates.
- Cable or data wiring that runs between or among separate buildings, apartments or dwelling units in a multi-tenant property. If you reside in a multi-tenant building, campus or military housing, you should discuss inside wire repair responsibility with the manager or owner of the building.
- Repair or replacement of any existing telephone/internet/cable wire and telephone jacks not installed or existing in accordance with accepted industry standards as determined by Bresnan.
- Inside cable outlets and cable wire used to receive unauthorized cable service.
- Trouble or problems existing prior to establishment of cable television service with Bresnan, or prior to selecting the Bresnan Service Assurance Plan.
- Repair or replacement of telephones, answering machines, television sets, VCRs, set-top boxes used for channel selection or equipment leased or provided for receiving video or other services or any other equipment except that some equipment may be provided and maintained by Bresnan and may be repaired or replaced as part of your service.
- Wiring that Bresnan is unable to access.
Available only to Bresnan customers not covered by other inside wire repair plans. Bresnan may immediately, and without notice, suspend or discontinue this service to a residence if service(s) are no longer being provided to the residence by Bresnan or if any misuse or abuse of the service occurs or if a hazard or danger to person or property exists which would prevent our technicians from performing the work in a safe manner.
Subject to any applicable rules or laws, Bresnan may discontinue the Bresnan Service Assurance service or change any of these Terms and Conditions. Bresnan will provide thirty (30) days prior written notice of any significant changes in the Terms and Conditions. This notice may be included in your monthly bill.
The Bresnan Service Assurance Plan requires a 3-month minimum after which you may discontinue the Bresnan Service Assurance service at any time by calling our customer service office (see Contact Customer Support for the phone number).
Bresnan shall not be liable for any injuries to persons or property arising out of installations, maintenance or repairs performed in connection with the Bresnan Service Assurance service nor shall Bresnan be liable for any other damages including, but not limited to, indirect, incidental, special or consequential damages, arising from the customer's use or inability to use such inside telephone wire, cable wire, internet wire, telephone jacks or cable outlets.
BRESNAN EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES RELATED TO THE BRESNAN SERVICE ASSURANCE PLAN. THIS DISCLAIMER EXPRESSLY INCLUDES, BUT IS NOT LIMITED TO, DISCLAIMER OF ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BRESNAN'S LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE AMOUNT PAID UNDER THIS AGREEMENT.
To report a telephone or cable problem that you think may be related to your inside wiring, please contact a Bresnan Customer Support representative (see Contact Customer Support). If You are not the owner of the Property where Bresnan will perform these services, You hereby warrant and represent that you have obtained all necessary permissions from the owner of the building and you will indemnify Bresnan from any liability arising from a breach of the representation and warranty.
